  1. Fat Tony says:

The High Court ruled him (& others) coldn’t be held in indefinite detention. Fair enough, I suppose.

But why did the government just let these POS just walk free? Who is going to suffer because of this – High Court judges? Not likely. Government ministers? Not likely.
As usual, it will be some poor ordinary person who had nothing to do with this decision.

Justice for ordinary people will soon have to be delivered by those same ordinary people – our governments do not care for us.

  2. Bruce of Newcastle says:

I still haven’t seen anything about indefinitely detained Daniel Duggan.
Who has done nothing wrong. Surely the decision covers him too?

  3. Rockdoctor says:

I managed to find this decision in full after a bit of digging that mentioned 5 justices at the hearing, no mention of the break up. Was it 5?

  4. Buccaneer says:

Australian officials had not contacted him to let him know his daughter’s killer would be freed.

‘Where is the human rights for the victim’s family? We are right here, we are still alive and suffering,’ he said.

‘I really wonder why Australia releases a murderer. It makes me think all the murderers of the world can go to Australia, spend time in immigration detention and eventually be released and become free men.’

Meanwhile, Uncle Albo is off swanning around the world, will we hear from him about Kung Fu Panda again?

    Mmm. Good point.

I can’t find that info re majority either, RD.

  6. Ed Case says:

    Researching Judge Jayne Jagot.
Wiki has no birthdate, it’s 1964 or 1965.
Seriously, no birthday, no mention of parents, the High Court makes a decision reflecting ALP policy on Mandatory Detention but totally opposed by real people, is anyone surprised?

  7. Lee says:

We release the absolute scum of the earth, but Duggan remains locked up on trumped-up politically motivated charges by a weak Australian government and AG, at the behest of a thoroughly corrupt Biden government.

  9. Graham says:

The case is NZYQ v Minister for Immigration, Citizenship and Multicultural Affairs & Anor [2023] HCATrans 154 (8 November 2023).

    The transcript is on AUUSTLII:
    http://www.austlii.edu.au/cgi-bin/viewdoc/au/cases/cth/HCATrans/2023/154.html

All 7 judges sat on the hearing. The Chief Justice announced at the end of the hearing that “at least” the majority of the judges agreed with the orders then pronounced.

Whether it is 6-1, 5-2, or 4-3 for the majority is not known yet.
    My guess is 6-1.
The result is, in part, a reflection of the poor judicial choices of the Coalition since the Turnbull government, and in particular George Brandis. They failed to appoint conservative to the Court. Now they are reaping the bitter fruits of their choices.

The only conservative judge appointed was Steward J.  There is no much he can do on his own.

  10. C.L. says:

    Thanks, Graham. Much appreciated.

  11. Old Lefty says:

Nor is anyone in our woke media baying for the blood of education department bureaucrats or teachers’ union leaders over this:

    https://www.abc.net.au/news/2023-11-20/queensland-teacher-accused-of-child-exploitation-offences/103125718

Now why am I not surprised?

  12. Rockdoctor says:

Thanks Graham. I got my info off Austlii in the end. I gathered there was a shunt left in the court after some of the more recent decisions that seemed to be made by people living in an alter reality.

I still am of the opinion Gageler is underqualified for his position compared to his peers.

That said the Government is appearing to shrug like Atlas (Admittedly expected) and the opposition are just waving arms, not proposing solutions that in the end will have to probably tread on Judicial toes.

  13. Ed Case says:

The Government is intentionally driving the bus off the road heading into a ditch.
The solution is this Government gets thrown out.
As the ride gets bumpier, more people will arrive at this conclusion.

  14. John of Mel says:

The result is, in part, a reflection of the poor judicial choices of the Coalition since the Turnbull government, and in particular George Brandis. They failed to appoint conservative to the Court. Now they are reaping the bitter fruits of their choices.

Maybe they thought that were appointing conservative judges. I’m just not sure they understand what “conservative” means.

  15. Old Lefty says:

Just as, John of Mel, some of the cardinals who voted for Jorge Bergoglio in 2013 thought they were getting a slightly conservative middle-of-the-road type.

  16. NFA says:

Are there any ‘conservatives’ left in the entire Australian judiciary?

  17. Ed Case says:

Mandatory Detention forever isn’t real conservative, it’s more Reactionary.
Whether there are Commonwealth Departments trying to send these people home, I don’t know but i’d guess there are.
The Stateless Rohingya who raped a ten year old boy in Australia should’ve faced the Death Penalty.
Now, some say the Death Penalty doesn’t deter, and I’d agree, since many viol;ent criminals are Psychopaths.
    But, deterrence isn’t the aim.
The aim is to remove these people from the society permanently.

  18. NFA says:

The aim is to remove these people from the society permanently.

I agree with what Ed Case says: 21 November, 2023 at 8:04 pm
